Terms of Service
1. Who we are
"Discord Translate" (the "Service") is a Discord application operated by an independent developer (the "Operator", "we", "us"), a Xaeryx project based in Alabama, United States. By adding the Service to a Discord server, enabling it, or using its commands, you agree to these Terms of Service (the "Terms"). If you do not agree, do not add or use the Service.

2. What the Service does
The Service is a Discord bot that, when invited into a voice channel by a permitted member, listens to the live conversation, transcribes and translates each speaker's speech in real time, and posts text captions to a Discord text channel. It processes audio only — it never accesses video or camera frames. Translation is performed by third-party providers (see the Privacy Policy) and is provided on a best-effort basis.
No audio is stored by the Service, and the Service does not create voiceprints or perform speaker biometric identification. Captions the Service posts into your Discord channel are ordinary Discord messages controlled by your server and Discord.
3. Eligibility
You must be at least 13 years old to use Discord and the Service, and at least 18 years old to make a purchase (a Pro subscription or credit packs). By purchasing, you represent that you are 18+ and authorized to make the purchase for the server.
4. Plans, billing, and refunds
The Service offers a Free trial (a one-time allowance of translated audio per server, currently 15 minutes, not recurring), pay-as-you-go credits (a prepaid, per-server balance bought in packs and spent on usage beyond the trial; credits do not expire), and a Pro tier (a per-server subscription that removes limits, subject to fair use).
All billing — Pro subscriptions and credit packs alike — is handled natively by Discord through Discord's monetization (App Subscriptions and one-time purchases). Discord processes your payment, manages renewals, calculates and collects any applicable taxes, and handles cancellations and refunds under Discord's own terms and policies. We never receive or store your payment card details. Because Discord is the merchant of record, refund and cancellation requests are governed by Discord; contact Discord support for billing disputes. A Pro subscription and any credits apply to the single Discord server (guild) they were purchased for; credits are consumed as you use the Service beyond the free trial and are non-transferable between servers.
We may change tier limits or pricing for future billing periods; changes do not affect a subscription period you have already paid for.
5. Consent and the server admin's responsibilities
Live translation means the Service is listening to and transcribing what people say in the voice channel. To protect everyone, the Service posts a clear, in-channel notice when it joins a voice channel, before it begins translating, and translation is always speaker-initiated (a member runs a command to start it). The Service is never silent or hidden.
By enabling or using the Service in a server, the server administrator and the member who starts it warrant that:
- they have authority to enable the Service for that server;
- they will ensure members in the channel are made aware that the conversation is being transcribed and translated; and
- they have obtained, or will obtain, any consent required by applicable law for that processing.
Members who do not consent should leave the voice channel. You are responsible for complying with the recording, wiretap, and privacy laws that apply to you and the people in your channel.
6. Acceptable use
You agree not to use the Service to:
- secretly record, surveil, or intercept anyone, or otherwise use it without the in-channel notice being visible;
- break the law, infringe others' rights, or violate Discord's Terms of Service or Community Guidelines;
- harass, abuse, or harm others, or process the speech of people who have not been notified;
- attempt to disrupt, overload, reverse-engineer, or circumvent usage limits or access controls of the Service.
7. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Machine translation and transcription are imperfect — we do not warrant that captions are accurate, complete, or suitable for any decision, and you should not rely on them for any high-stakes, legal, medical, or safety-critical purpose. The Service depends on Discord and third-party providers and may be interrupted, delayed, or discontinued at any time.
8. Limitation of liability
To the maximum extent permitted by law, the Operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or relating to the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of (a) the amounts you paid that were actually received by the Operator for the Service in the twelve (12) months before the claim, or (b) USD $50. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Indemnification
You — and, where applicable, the server administrator who enabled the Service — agree to defend, indemnify, and hold the Operator harmless from any claims, damages, liabilities, and costs (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or any claim that a member of your channel did not consent to being transcribed or translated.
10. Suspension and termination
You may stop using the Service at any time by removing the bot from your server (and cancelling any Pro subscription via Discord). We may suspend or terminate access — in whole or in part — if we reasonably believe these Terms or the law are being violated, or to protect the Service, its users, or third parties. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability, indemnification, governing law) will survive.
11. Dispute resolution; arbitration and class-action waiver
Most disputes can be resolved by emailing us first at baniabradyy@gmail.com; please contact us before filing a claim. To the extent permitted by law, any dispute that cannot be resolved informally will be resolved by binding individual arbitration rather than in court, and you and the Operator each waive any right to a jury trial or to participate in a class action. You may opt out of this arbitration and class-waiver provision by emailing us within 30 days of first accepting these Terms. This section does not prevent either party from seeking relief in small-claims court.
12. Governing law
These Terms are governed by the laws of the State of Alabama, United States, and applicable U.S. federal law, without regard to conflict-of-laws rules. Subject to the arbitration provision above, the state and federal courts located in Alabama will have exclusive jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and material changes take effect when posted here. Your continued use of the Service after a change means you accept the updated Terms.
